Official Rules: iPad Giveaway
The iPad is a really cool little toy. And having a contest to give away an iPad (+ some other prizes) is a fun thing for JobMonkey to do. Unfortunately, whenever you have a contest like this - a random drawing in this case - you have to post official rules. At least that's what our attorney tells us! So here's the legal stuff that includes prize details too:
NO PURCHASE IS NECESSARY TO ENTER OR WIN. ENTRY INTO THIS DRAWING CONSTITUTES ACCEPTANCE OF THESE DRAWING RULES. VOID WHERE PROHIBITED.
In order to be eligible to win one of the prizes or participate in the Drawing, you must be listed as a Fan of the JobMonkey Facebook Page by midnight, May 13, 2010. (12:00 AM Pacific Standard Time). Your name will not be included in the drawing unless you are listed as a Fan at the time of the drawing, which will be on or shortly after May 14, 2010.
To be eligible to enter the 2010 JobMonkey Facebook iPad Drawing (hereinafter, "Drawing"), you must have (i) become a Fan of the JobMonkey Facebook Page and be (ii) above the age of majority in the jurisdiction in which you reside at the time of entry. By entering the sweepstakes you are confirming you are sixteen (16) years of age or older. Employees, officers, directors, and contractors of JobMonkey, its agents or affiliates, advertising or promotional agencies, and their immediate families and those living in their households, are not eligible to participate in the Drawing. Void where prohibited. All federal, state, and local laws and regulations apply.
The Contest begins at 12:01 a.m. Pacific Standard Time (PST) on March 18, 2010, and ends at 11:59 p.m. PST on May 13, 2010 ("Term").
4. TO ENTER
No purchase IS NECESSARY TO ENTER OR to WIN. During the Term, to enter the Drawing, visit the JobMonkey Facebook page and click the Become a Fan button. It is entrant's sole responsibility to ensure that they successfully become a Fan after clicking the Become a Fan button.
Note: You must be a JobMonkey Facebook Fan at the time of the drawing to be eligible to receive the prize(s) described below.
LIMIT: ONE (1) ENTRY PER PERSON. Subsequent or duplicate entries will be disqualified. JobMonkey is not responsible for late or misdirected entries, or for any computer-related, online, telephonic, or technical malfunctions that may occur. By entering, you agree to be bound by these Official Rules. If you are entering on behalf of your employer, these rules are binding on you, individually, and your company.
In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the Facebook Account - the person whose name is on the Facebook Account. A selected entrant may be required to provide JobMonkey with proof that he/she is the authorized account holder of the Facebook Account associated with the selected entry.
Only winning entrants will be notified directly. Notifications will be made via Facebook. After the Term, JobMonkey will be awarding the following Prizes:
Prizes: One (1) prize winner will be selected by a random drawing to receive an Apple iPad (16 gig wi-fi version). Total MSRP: US$499.00.
Four (4) prize winners will be selected by a random drawing to receive US$25.00 Amazon gift certificates.
All decisions on all matters pertaining to the Drawing are final. Winners are responsible for any and all taxes. JobMonkey will ship to destinations in the U.S. and Canada (standard ground or air freight). If the iPad winner resides outside of the U.S. or Canada, a US$500 Amazon gift certificate will be substituted for the iPad. Amazon gift certificates are delivered via email only, so winners must have a valid email address. JobMonkey reserves the right to substitute a prize of equal or greater value. Limit one prize per person, family, or household. Odds of winning depend on the number of eligible entries received. If a winner is a subject to the U.S. tax law (U.S. citizen or U.S. resident), he or she must complete and submit to Sponsor IRS form W-9 prior to receiving the prize.
6. WINNER NOTIFICATION
Random selection of the potential winners will occur on or about May 14, 2010, from among all eligible entries received (JobMonkey Facebook Fans). Winners must be listed as a fan at the time of the actual drawing. Prize drawing will be conducted at JobMonkey's office in Seattle, Washington. The potential winners will be notified through Facebook on or about May 14, 2010. Potential winners will have fourteen (14) days from notification to claim their prize. JobMonkey and its affiliates, subsidiaries, employees, contractors, agents, officers and directors, advertising and Drawing agencies, and their respective officers, directors, employees, and their respective agents will not be liable for unsuccessful efforts to notify a winner. No prize transfer, assignment, or substitution by winners permitted. JobMonkey may substitute the prize for one of equal or greater value. All federal, state, and local taxes, fees, and surcharges on prizes are the sole responsibility of the winners. Winners may be required to complete a release and provide tax identification or other information prior to receiving their prize. If any potential winner declines the prize, fails to claim the prize, is unavailable for prize fulfillment, fails to abide by the Official Rules, or is ineligible, Sponsor may select an alternate winner from all remaining eligible entries. If any prize or prize notification is returned as undeliverable, that prize is forfeited and JobMonkey may select an alternate winner from all remaining eligible entries.
7. LIMITATION OF LIABILITY
JobMonkey reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Drawing.
By participating, entrants and winners release JobMonkey, its affiliates, parent, and subsidiary companies; its employees, agents, and officers; and its advertising and promotion agencies, as well as all others associated with the development and execution of this Drawing, from and against any and all liability with respect to or in any way arising from the Drawing and the awarding and use of the prizes. JobMonkey assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; or alteration of entries.
Participants also agree (a) to be bound by these Official Rules; and (b) that the decisions of JobMonkey are final on all matters relating to the Drawing. Winners agree to be bound by these rules and the decisions of JobMonkey, whose decisions are final and binding.
If you are acting within the scope of your employment, as an employee, contractor, or agent of another party, you warrant that such party has full knowledge of your actions and has consent thereto. You further warrant that your actions do not violate your employer's or company's policies and procedures.
This Drawing is governed by the laws of Washington state, USA, without regard to the conflicts of law provisions.
9. WINNERS LIST
To obtain the names of the winners, send a request, along with a self-addressed, stamped envelope, to Legal Department, JobMonkey, Inc., PO Box 3956, Seattle, WA 98124 USA. You will be required to sign a confidentiality agreement prior to receiving the winners list.
